Terms of Service for Parcel Forwarding Service

1. Introduction

  • These Terms & Conditions (“Terms”) govern the use of Smart Logistics Ltd t/a SmartShip parcel forwarding services.
  • By registering with SmartShip and using our services, you agree to be bound by these Terms.
  • Smart Logistics Ltd t/a SmartShip is operated by SmartShip, Unit 1A Heatherview Business Park, Athlone Road, Co Longford, N39KD82, Ireland.

2. Service Description

  • SmartShip provides customers with a unique Irish address to receive parcels.
  • Upon receipt, SmartShip offers forwarding services to the customer’s chosen destination, subject to payment of applicable fees.
  • Customers may select from available shipping carriers and service levels.
  • SmartShip’s parcel forwarding service is strictly limited to forwarding packages. It cannot be used as a mail forwarding service for registering a business, opening a bank account, applying for credit, or engaging in any other activities requiring a permanent mailing address.

3. Customer Responsibilities

  • Customers must provide accurate and complete information when registering and placing orders.
  • Customers are responsible for ensuring that items shipped to SmartShip comply with all applicable laws and regulations.
  • Customers must declare full and accurate contents for international shipments to enable proper customs clearance.
  • Customers are responsible for ensuring that packages received at the SmartShip warehouse are in good condition before forwarding. SmartShip only receives packages and does not inspect or verify their condition prior to dispatch.
  • When signing up for a SmartShip forwarding address, customers are required to provide a valid copy of their government-issued ID and proof of address. These documents are necessary to validate the account and authorize the use of SmartShip’s warehouse address.

4. Prohibited Items

SmartShip will not accept, store, or forward items that are:

  • Hazardous materials (flammable, explosive, toxic, corrosive).
  • Weapons, ammunition, or replicas.
  • Illegal substances or contraband.
  • Perishable goods requiring refrigeration.
  • Items restricted by carriers or customs authorities.

5. Customs & Duties

  • For shipments outside the EU, customers must provide detailed item descriptions for commercial invoices.
  • SmartShip is not responsible for delays, fines, or additional duties arising from inaccurate or incomplete declarations.
  • Customs clearance is the sole responsibility of the customer.
  • In cases where international return packages are received and import duties have not been paid, SmartShip will incur the charges initially. These charges will then be passed on to the customer, and payment must be settled before the package can be forwarded again.

6. Fees & Payment

  • Customers agree to pay all applicable service fees, shipping charges, and taxes before dispatch.
  • SmartShip operates on a prepaid account basis. All fees must be paid in advance before any package is forwarded to the customer.
  • Orders will not be shipped until payment is confirmed.
  • A tracking number will be provided once the parcel has been forwarded.
  • Our shipping partners include DPD, FedEx, GLS, and UPS.

7. Insurance Cover

  • SmartShip provides standard insurance cover of €100 for all packages.
  • Customers who require higher insurance coverage must request this in advance and pay any applicable additional fees.
  • Claims for loss or damage must be submitted directly to SmartShip within the carrier’s claim period.

8. Delivery & Liability

  • SmartShip will dispatch parcels promptly after payment confirmation.
  • Delivery times are estimates provided by carriers and not guaranteed by SmartShip.
  • SmartShip is not liable for delays, loss, or damage once parcels are handed over to the carrier, except as covered under the insurance policy.

9. Address Changes

  • Once a parcel has been shipped, SmartShip cannot change the delivery address unless the package is still held in our warehouse.

10. Storage Policy

  • Parcels may be stored free of charge for a limited period (e.g., 7 days).
  • Extended storage may incur additional fees.
  • For unclaimed packages held for a period of up to 6 months (24 weeks), SmartShip will contact the customer on a monthly basis regarding storage charges. If these charges remain unpaid for the full 6-month period, the package will be disposed of, and the customer will forfeit any right to claim the package from SmartShip.

11. Privacy & Data Protection

  • SmartShip values your privacy and protects your personal information.
  • SmartShip does not share your information with third parties. Information will only be disclosed to relevant government authorities if required as part of an investigation or to comply with legal obligations.

12. Limitation of Liability

  • SmartShip’s liability is limited to the value of the forwarding service fee paid and the standard insurance cover of €100, unless additional insurance has been purchased.
  • SmartShip is not responsible for indirect, incidental, or consequential damages.

13. Right to Refuse Service

  • SmartShip reserves the right to cancel or refuse service to any customer under certain circumstances, including but not limited to suspected fraud, misuse of services, violation of these Terms, or where required by law or regulatory authorities.

14. Account Deletion

  • SmartShip regularly cleans its system of dormant client accounts with no activity for more than 6 months.
  • Any documents provided during account validation (such as ID or proof of address) will be securely deleted or securely shredded when the account is removed.

15. Termination

  • SmartShip reserves the right to suspend or terminate accounts that violate these Terms.
  • The address provided to you by SmartShip may not be used, without our knowledge or prior approval, for parcel redirection to any other location in order to avoid SmartShip charges. Any such action constitutes a severe violation of our Terms of Service and will result in immediate review and potential termination of your account.

16. Governing Law

  • These Terms are governed by the laws of Ireland.
  • Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.
